Oak Lawn Fence Permit Requirements ​

The Village of Oak Lawn requires a building permit for both the replacement of an existing fence and all new fence installations. The following needs to be submitted before getting a permit issued:

  • $30 fence permit fee
  • A fence permit application filled out
  • And a copy of your Plat of Survey

The Village of Oak Lawn's Building Division will not issue a permit if the fence company or contractor you list on the application is not correctly licensed and insured to do business inside the city limits.

It is against the law for any person or fence company to replace or install a new fence in the Village of Oak Lawn without first obtaining a fence construction permit from the Building Department.

When applying for the permit, you will need to provide a drawing showing the intended location of the fence on your property as it relates to lot lines and existing permanent improvements. They will need additional details such as the type of fence installation, the kinds of fence materials to be used, and the planned height of the fence.

Residential Fencing Requirements ​

When it comes to residential fencing in the Village of Oak Lawn, the maximum allowable height of the fence shall be 6 feet regardless of where the fence installation takes place on your property. This height requirement is measured by fence companies, from the established grade in your yard to the top-most height of any given fence section.

You cannot install a fence:


  • Past the front yard building line
  • Past the side street yard on a corner lot
  • In a public right-of-way
  • In any easement (see below for exceptions)

Special Rules Regarding Easements ​

If you are looking to have a fence installed in an easement, there are some essential things to know ahead of time. You will need to sign and give the Village of Oak Lawn a special release absolving them from all and any liability or damage caused to your fence in the event they need to access utilities. It is not uncommon for the Village to repair, maintain, install or remove utilities. But it is crucial for you to know, once you sign the release, they will not be held responsible for damages caused to your fence in the process. If you know you are going to be installing a fence in an easement, you will want to talk with your fence company ahead of time, so that they can build individual fence sections in that area that are readily removable so that the Village can perform their work. The Village of Oak Lawn will in no way be held liable for any expenses regarding the removal or replacement of fence sections involved in this process. ​

Additional Fence Rules & Regulations ​

All fences are required to have at least one gate somewhere on the property. The finished side of the fence must face the streets, alleys, and neighboring properties. The side of the fence that shows the fence posts and support beams must face the interior of your yard.

While fence companies are allowed to install picket fences in the Village of Oak Lawn, the following types of fences are never allowed:


  • Chicken wire
  • Square welded mesh wire
  • Barbed wire
  • Electrically charged wire
  • Temporary snow fence
  • Solid concrete block
  • Any fence topped with sharp edge material

​It is also essential to keep in mind that your fence company must use consistent material throughout the entire length of the fence. The fence installation must be constructed in such a way so that it can withstand high wind pressure.

Requirements for Swimming Pools ​

If you currently have a swimming pool in your backyard or plan to have one installed, it is crucial to note there are special rules and regulations when it comes to residential fence installations. All permanently constructed swimming pools must be enclosed by a fence that is no less than 6 feet in height. Your fence company must install a self-closing gate and the latch that works the gate be at least 4 and a half feet from the ground. These rules are primarily in place for protecting young children, whether your kids or other kids in the neighborhood, that could wander into your backyard and accidentally fall into the pool and drown.

Penalties & Fines 

It is imperative that you talk with your fence company (hopefully by now you have chosen to use Illinois Fence Company) and make sure you understand the Village of Oak Lawns rules and regulations when it comes to installing residential fencing in your backyard. In the event you do not comply with the information presented above, the Village has the ability to fine you up to $100 per day per offense until you remedy the situation. ​
